Welcome to Publiqi.com (“Publiqi”, “we”, “our”). These Terms of Use govern access to and use of our online platform available at https://app.publiqi.com, as well as services, integrations, APIs, and any application made available by Publiqi (collectively, the “Services”).

By accessing or using Publiqi, you (“User”, “you”, “your”) represent that you have read, understood, and agree to these Terms of Use and our Privacy Policy.

If you do not agree, you must not use the Services.


1. Scope of the Services

Publiqi provides a SaaS (Software as a Service) platform that allows the User to:

  • Import, view, organize, and manage social media content in a centralized interface;
  • Analyze metrics and performance insights for content;
  • Create, adapt, and edit social media content, including with the help of artificial intelligence;
  • Connect social accounts via official APIs or authorized integrations;
  • Publish, schedule, and manage posts on supported networks;
  • Define and maintain brand identity (brand DNA) to guide content production;
  • Collaborate as a team on content for one or more projects.

Supported networks currently include Instagram. Integrations with other platforms (such as LinkedIn, Threads, TikTok, and YouTube) may be added in the future, subject to the policies and availability of those external platforms.

Publiqi reserves the right to change, suspend, or discontinue features of the Services at any time, with reasonable prior notice when feasible.

2. User Account

To use the Services, the User must:

  • Create an account with truthful, up-to-date information;
  • Keep credentials secure and not share them;
  • Be solely responsible for all activity under the account.

The following is prohibited:

  • Creating automated, fake accounts or impersonating third parties;
  • Sharing access with third parties without specific authorization from the team feature;
  • Using the platform for unlawful, unethical purposes or in a way that infringes third-party rights;
  • Attempting to access restricted areas, bypass security mechanisms, or reverse engineer the platform.

If you detect unauthorized use, you must notify Publiqi immediately at contato@publiqi.com.

3. Connection to Third-Party Platforms

When connecting social networks, the User:

  • Authorizes Publiqi to access data permitted by the official APIs of each platform;
  • Agrees to the terms and policies of the connected platforms;
  • Is responsible for maintaining valid access (tokens, permissions, etc.);
  • Acknowledges that Publiqi stores access tokens in encrypted form solely to maintain the integration.

Publiqi is not affiliated with Instagram, Meta, Google, YouTube, LinkedIn, TikTok, or any other third-party platform, and does not guarantee:

  • Continuous availability of integrations;
  • Successful delivery of posts due to external failures;
  • Maintenance of features that depend on third parties;
  • That changes to third-party APIs or policies will not affect feature availability.

4. Nature of Content

The User is solely responsible:

  • For content generated, uploaded, published, or managed through Publiqi;
  • For ensuring they have rights to the materials used;
  • For complying with applicable laws and copyright;
  • For AI-assisted content, including reviewing and approving before publication.

It is expressly prohibited to use Publiqi for content that:

  • Infringes intellectual property rights;
  • Is defamatory, discriminatory, offensive, or illegal;
  • Is pornographic or directed at minors;
  • Promotes hate, extremism, violence, or disinformation;
  • Constitutes spam, phishing, or any malicious content;
  • Violates the policies of connected social platforms.

Publiqi may remove content or suspend accounts that violate these provisions without prior notice.

5. Use of Artificial Intelligence

Publiqi may use artificial intelligence (AI) models to help create, adapt, and suggest content. By using these features, the User acknowledges and agrees that:

  • AI-generated content is provided as a suggestion and must be reviewed by the User before publication;
  • Publiqi does not guarantee the accuracy, originality, or suitability of AI-generated content;
  • The User is ultimately responsible for all published content, whether or not AI was involved;
  • User data used to generate content via AI (such as brand instructions, audience, tone of voice) is processed according to our Privacy Policy;
  • Data obtained via third-party platform APIs (Google, Instagram) is not used to train AI models.

6. Plans, Payments, and Renewals

Publiqi offers free and paid plans. When subscribing to a plan:

  • The User agrees to the fees, billing cycle, and recurring charges;
  • Applicable taxes may be added to the amount;
  • Renewal is automatic until canceled by the User;
  • Cancellation does not entitle to a proportional refund, except where required by law;
  • Access to paid features continues until the end of the period already paid.

Payment methods are processed by authorized third parties (such as Stripe).

Publiqi may change prices or features at any time with reasonable prior notice. Price changes do not affect periods already paid.

7. Usage Limits and Quotas

Plans may include limits on:

  • Number of connected accounts;
  • Number of posts, schedules, and automations;
  • Data volume and API requests;
  • Number of team members;
  • Number of projects and workspaces.

Publiqi may suspend use that:

  • Exceeds contracted limits;
  • Constitutes abuse or system degradation;
  • Circumvents protection mechanisms or quotas;
  • Compromises platform stability or security for other users.

8. Intellectual Property

The following belong exclusively to Publiqi:

  • The software, name, brand, design, interface, and technologies;
  • Models, workflows, and automation algorithms;
  • Prompts, templates, and content models provided by the platform;
  • Any materials made available to users.

These Terms do not grant any rights beyond limited use of the platform for the duration of the User account.

The User retains ownership of their own content created or published via Publiqi. By using the Services, the User grants Publiqi a limited, non-exclusive, revocable license to process, store, and display their content solely to provide the Services.

9. Privacy and Data

Collection, processing, and sharing of data follow Publiqi's Privacy Policy and applicable law, including the Brazilian LGPD.

The User agrees that:

  • Account data and content may be stored and processed on external servers;
  • Usage statistics may be used to improve the service, anonymized when possible;
  • Publiqi may access data strictly necessary for technical support;
  • Integration data with third-party platforms is handled according to those platforms’ policies and our Privacy Policy.

10. Suspension and Termination

We may suspend or terminate accounts that:

  • Violate these Terms;
  • Create operational, technical, or legal risks;
  • Use the service abusively or unlawfully;
  • Remain inactive for an extended period (free plans).

In cases of serious violation, removal may be immediate, without prior notice.

The User may request account cancellation at any time through platform settings or by email. After cancellation, data will be handled according to our Privacy Policy.

11. Warranties and Disclaimer

Publiqi is provided “as is” and “as available”.

We do not warrant:

  • That the service will be error-free, uninterrupted, or free of attacks;
  • Financial results, engagement, or visibility on social networks;
  • Ongoing compliance with external changes to APIs and third-party policies;
  • That AI-generated content will be accurate, original, or fit for any particular purpose.

Publiqi is not liable for:

  • Reputational damage or losses arising from the User’s posts;
  • Content removals by connected platforms;
  • Failures caused by social networks, external providers, or User conduct;
  • Data loss due to User actions (such as account deletion);
  • Damage from misuse of access credentials;
  • Service interruptions due to scheduled or emergency maintenance.

12. Limitation of Liability

To the maximum extent permitted by law, Publiqi’s total liability is limited to the amount actually paid by the User in the 12 months preceding the event giving rise to the claim.

Publiqi will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, loss of business, opportunities, or data, even if advised of the possibility of such damages.

For free-plan users, Publiqi’s liability is limited to the maximum permitted by applicable law and, in any case, shall not exceed the equivalent of one (1) month of the lowest-priced paid plan in effect at the time of the event.

13. Indemnity

The User agrees to indemnify and hold harmless Publiqi, its directors, employees, and partners from any claims, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Violation of these Terms by the User;
  • Content published or managed by the User through the platform;
  • Violation of third-party rights by the User;
  • Misuse of the User’s access credentials.

14. Changes to the Terms

We may update these Terms with at least 15 (fifteen) days’ prior notice via the platform or email. Continued use after changes constitutes full acceptance of the new version.

If the User does not agree with the changes, they must stop using the Services and may request account cancellation.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil.

Any dispute shall be submitted to the courts of Porto Velho/RO, with waiver of any other forum, however privileged.

The parties agree to attempt to resolve disputes amicably before litigation, including through mediation or conciliation.

16. General Provisions

  • If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • Publiqi’s failure to exercise any right under these Terms does not constitute a waiver of that right.
  • These Terms, together with the Privacy Policy, constitute the entire agreement between the User and Publiqi regarding use of the Services.
